5  Marketing and profiling

If you subscribe or where law otherwise permits, we may send news, product updates, invitations and offers by email or other selected channels. You can unsubscribe at any time through the link in a message or by contacting us. Unsubscribing does not stop service messages relating to an order or account.

We may use purchase, browsing and interaction data to group audiences or tailor content and offers. Where consent is required for tracking or personalised advertising, we will request it through the website consent tool. You may change your choices there at any time.

6  Cookies and similar technologies

We use technologies necessary for the website, shopping basket, checkout, security and preference settings. With your consent where required, we may also use analytics, performance, personalisation and advertising technologies.

The cookie consent tool provides current details of the technologies in use, their providers, purposes and duration. You can reject non-essential technologies or change your choices through that tool. Browser settings may also block cookies, although some website functions may then not work correctly.

7  Who receives personal data

We disclose personal data only where reasonably necessary to operate our business, provide services or meet legal obligations. Recipients may include:

  • website, e-commerce, cloud-hosting and IT support providers;
  • payment processors, banks and fraud-prevention providers;
  • warehouses, fulfilment partners, couriers and customs providers;
  • customer-service, email, CRM, analytics and advertising providers, subject to your choices where required;
  • professional advisers, insurers, auditors and authorities;
  • a buyer, investor or successor in connection with a proposed or completed corporate transaction; and
  • other parties where you direct us, consent, or disclosure is required or permitted by law.

Service providers may process data only for authorised purposes and are required to protect it under applicable contracts and law. We do not sell personal data for money. Certain advertising disclosures may be treated as “sharing”, “sale” or targeted advertising under some local laws, in which case we provide the rights and choices required by those laws.

8  International transfers

We are based in Switzerland. Some recipients or systems may be located in the European Economic Area, the United Kingdom, the United States or other countries. Those countries may not provide the same level of data protection as your home country.

Where required, we use recognised safeguards for international transfers, such as an adequacy decision, approved standard contractual clauses with any required Swiss adaptations, or another lawful transfer mechanism. You may contact us for information about the safeguards relevant to your data.

9  How long we keep personal data

We retain personal data only for as long as needed for the purposes described above, taking account of contractual, tax, accounting, warranty, limitation, fraud-prevention and legal requirements. In general, core order and accounting records may be retained for up to 10 years after the relevant transaction, unless a longer or shorter period is required or justified.

Account data is normally kept while the account remains active. Customer-service and marketing records are kept for as long as needed to manage the relationship and preferences. Cookie and analytics retention varies by technology and is shown in the consent tool. Data may be retained longer where necessary for a legal claim, investigation or legal hold. It is then deleted or anonymised when no longer required.

10  Data security

We use appropriate technical and organisational measures designed to protect personal data against accidental or unlawful loss, alteration, access or disclosure. Access is limited to people and providers who need it for authorised purposes. No internet transmission or storage system can be guaranteed to be completely secure.

11  Your rights

Depending on the law that applies, you may have rights to request access to personal data, correction, deletion, restriction, portability or delivery in a commonly used format, and to object to certain processing. Where processing is based on consent, you may withdraw consent at any time without affecting earlier lawful processing.

You may object at any time to direct marketing, including related profiling. Where processing is based on legitimate interests, you may object for reasons relating to your situation. Some rights are subject to exceptions, including legal retention duties and the rights of other people.

To exercise a right, contact info@frenckenberger.com. We may request information needed to verify your identity. You may also complain to the Swiss Federal Data Protection and Information Commissioner. If EU or UK data protection law applies, you may complain to the competent supervisory authority where you live or work.

12  Automated decisions

We do not currently make decisions based solely on automated processing that produce legal or similarly significant effects for customers. Payment and fraud-prevention providers may carry out automated checks under their own responsibility. If this practice changes, we will provide the information and safeguards required by applicable law.

13  Children

Our website and products are not directed to children, and we do not knowingly collect personal data from children who cannot lawfully provide it. If you believe a child has provided data to us without appropriate authorisation, please contact us so that we can review and delete it where required.

14  Third-party websites and social media

Links, embedded content and social-media features may be operated by third parties. Their processing is governed by their own privacy notices. We encourage you to review those notices before providing information or using an external service.

15  Changes to this Policy

We may update this Policy when our practices, services or legal obligations change. We will post the revised version with a new update date and provide additional notice where required.
